Experience Waiver

1. Recognition of Inherent Risk

By choosing to participate in any class, workshop, or hands-on activity hosted by Talisman Gallery, I acknowledge that such activities carry inherent risks. These risks may include, but are not limited to, physical injury, illness, permanent disability, death, or loss of or damage to personal property. I further acknowledge that such outcomes may result from my own actions or inactions, the conduct of other participants, the actions of Gallery staff, or circumstances beyond anyone's control.

2. Voluntary Assumption of Risk

I confirm that I am participating in Gallery activities of my own free will. I have been made aware that activities may involve, without limitation: the use of hand tools and power equipment, open flames or heat sources, sharp implements, physical exertion, and exposure to outdoor or workshop environments. With full understanding of these conditions, I voluntarily and knowingly accept all risks—both those that are foreseeable and those that are not—associated with my participation, and I take personal responsibility for any consequences that may arise.

3. Release and Discharge of Liability

In consideration of being permitted to participate in activities at Talisman Gallery, I—acting on behalf of myself, my heirs, legal representatives, executors, and assigns—irrevocably release, discharge, and covenant not to sue Joshua Lawson trading as Talisman Gallery, along with its employees, contractors, volunteers, agents, and any affiliated parties (together, the "Released Parties") from any and all claims, demands, losses, suits, or liabilities of any nature—whether known or unknown, present or future—arising directly or indirectly from my participation in any Gallery activity.

4. Indemnity

I agree to indemnify and hold harmless the Released Parties against any claim, loss, damage, cost, or expense (including reasonable legal fees) brought by me or on my behalf, or by any third party, that arises out of or is connected to my participation in activities at Talisman Gallery. This obligation applies regardless of whether such claims are known or unknown at the time of signing.

5. Consent to Emergency Medical Care

In the event that I sustain an injury or become unwell during my participation at Talisman Gallery, I authorise the Gallery and its staff to seek or arrange emergency medical assistance on my behalf. I accept full financial responsibility for any medical treatment, emergency services, or transport costs incurred as a result.

6. Governing Law

This Agreement is governed by and interpreted in accordance with the laws of the State of New South Wales, Australia. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.

7. Severability

Should any individual clause or provision of this Agreement be found to be unenforceable or void by a court of competent jurisdiction, that clause shall be severed from the Agreement. The remaining provisions shall continue in full force and effect as though the severed clause had not been included.

8. Entire Agreement

This document constitutes the complete and entire agreement between the participant and Talisman Gallery with respect to the subject matter contained herein. It replaces and supersedes all prior discussions, representations, or agreements—whether verbal or written—relating to participation in Gallery activities.

BY SIGNING BELOW, I CONFIRM THAT I HAVE READ AND FULLY UNDERSTOOD THIS WAIVER AND RELEASE OF LIABILITY AGREEMENT IN ITS ENTIRETY. I APPRECIATE THAT I AM RELINQUISHING SIGNIFICANT LEGAL RIGHTS, INCLUDING ANY RIGHT TO BRING A CLAIM OR ACTION AGAINST THE RELEASED PARTIES. I SIGN THIS AGREEMENT FREELY, WITHOUT COERCION, AND WITH THE INTENTION THAT IT OPERATE AS A FULL AND UNCONDITIONAL RELEASE OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

Terms & Conditions

By booking and participating in a class with Talisman Gallery, you agree to the following Terms and Conditions. These terms outline the conditions for participation, cancellations, refunds, and other key policies.

1. Eligibility

Participants must be 14 years or older. Those under 14 will need supervision by a parent or guardian.

Participants must be physically able to engage in physical activities, or have a physically abled carrer to conduct tasks on behalf of the participant, including the handling of tools and materials associated with blacksmithing.

Talisman Gallery reserves the right to refuse participation if they believe the individual poses a safety risk to themselves or others.

2. Booking and Payment

All bookings are made online through the Talisman Gallery website.

A confirmation email will be sent upon successful booking. Please ensure your contact information is correct at the time of booking.

3. Cancellation and Refund Policy

Cancellations by Participant:

Cancellations made more than 14 days prior to the class date are eligible to reschedule to a later available date.

Cancellations made between 14-7 days are elegable to 50% refund or 75% vlaue transfer.

Cancellations made 7 days or less are not eligable for a refund.

Consumer Law Notice:

Nothing in this policy excludes, restricts, or modifies any rights you may have under the Australian Consumer Law, including guarantees that services will be provided with due care and skill.

Cancellations by Talisman Gallery:

In the event Talisman Gallery cancels a class due to unforeseen circumstances, participants will be offered the option to reschedule or receive a full refund.

4. Safety and Participant Responsibilities

All participants are required to wear appropriate clothing (including closed-toe shoes) during classes. Ear plugs and eye protection are provided.

Participants must follow all safety instructions provided by the instructor. Failure to comply may result in removal from the class without refund.

To the extent permitted by law, Talisman Gallery is not liable for any injuries or damages caused by failure to adhere to instructions or improper use of tools.

5. Acknowledgment of Risk and Liability Waiver

By acknowledginf the 'Experience Waiver', you agree to the terms outlined in the Waiver and Release of Liability Agreement.

Participation involves inherent risks, including but not limited to physical injury, property damage, or death.

Participants assume all risks associated with the class activities.

A signed waiver must be completed prior to attending the class.

6. Medical Emergencies

In the event of injury or illness, Talisman Gallery staff may administer first aid or seek medical assistance. Any medical costs incurred will be the responsibility of the participant.

7. Code of Conduct

Talisman Gallery aims to foster a safe, inclusive, and respectful environment.

Harassment, disruptive behaviour, or inappropriate conduct will not be tolerated and may result in removal from the class without refund.

8. Force Majeure

Talisman Gallery is not responsible for cancellations or disruptions due to events beyond its reasonable control, including but not limited to extreme weather, natural disasters or public emergencies.

9. Copyright and Media Consent

Talisman Gallery may take photos or videos during classes for promotional purposes. By agreeing to the terms and conditions, you consent to the use of your image unless you notify us in writing prior to the class.

10. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

11. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Amendments

Talisman Gallery reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on the website, and it is the participant’s responsibility to review them before booking.
